Article 1. Introduction and Data Controller
1.1 This Privacy Policy describes how APOC Co., Ltd. (株式会社APOC) (the “Company”, “we”) collects, uses, stores, discloses and transfers personal data in connection with Thailand Public Wire (the “Service”).
1.2 The Company is the data controller in respect of the personal data described in this Privacy Policy. The Company is a company incorporated under the laws of Japan and is a private commercial entity; it is not a government agency or public institution.
1.3 This Privacy Policy forms an integral part of the Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.
1.4 The Company complies with the Personal Data Protection Act B.E. 2562 (2019) of Thailand (PDPA) and the Act on the Protection of Personal Information of Japan (個人情報の保護に関する法律), each to the extent applicable.
Article 2. Scope
2.1 This Privacy Policy applies to personal data collected through the Service, including from Publishers, Media Partners, Journalists and visitors to the Service.
2.2 This Privacy Policy does not apply to: (a) the websites or services of any third party, including Media Partners, Publishers, search engines and social media platforms; or (b) information that a Publisher chooses to include in the body of a Press Release, which is published to the public by the Publisher’s own decision (see Article 6).
Article 3. Personal Data We Collect
3.1 Publisher registration data: organisation name, representative or contact person’s name, department and job title, email address, telephone number, website URL, address, and industry or category.
3.2 Media Partner registration data: outlet name, outlet type, website URL, coverage area and subject areas, circulation or audience information, contact person’s name, department and job title, email address, telephone number, and any evidence submitted for verification purposes.
3.3 Journalist data: the name, job title, area of coverage and, where provided, the contact details and photograph of a Journalist, in each case as registered with or identified to the Service by a Media Partner.
3.4 Content data: Press Releases, images and captions, Media-Only Information, Media Kits, and any personal data contained within them.
3.5 Usage data: IP address, browser type, device and operating system, referring URL, pages viewed, date and time of access, and records of actions taken within the Service, including submissions, approvals, downloads of Media Kits and, if the Direct Delivery Feature is launched, delivery and open status.
3.6 Cookie and similar data: as described in Article 14.
3.7 Communications data: the content of enquiries, correspondence and support requests sent to the Company.
3.8 The Company does not intentionally collect special or sensitive categories of personal data (such as data concerning medical history, genetic information, sexual life, health examinations or criminal records) through the Service. Users should not submit such data.
Article 4. Purposes of Use
4.1 The Company uses personal data for the following purposes:
(a) to provide, operate and maintain the Service;
(b) to create and authenticate accounts;
(c) to verify and re-verify Media Partners and to prevent fraudulent or improper registration;
(d) to publish and distribute Press Releases and to operate the public archive;
(e) to operate and publish the Media Directory (subject to Article 6);
(f) to control access to Restricted Materials and to log, monitor and audit such access;
(g) to operate the Direct Delivery Feature once launched (see Article 8);
(h) to communicate with Users about the Service, including notices of changes;
(i) to ensure security, prevent abuse and enforce the Terms of Service;
(j) to compile statistics and analytics and to improve the Service;
(k) to use Users, Media Partners and Journalists as references and case studies for the Service, APOC Wire and the Company’s other products and services, as set out in Article 12 of the Terms of Service and Article 7 below;
(l) to respond to enquiries; and
(m) to comply with applicable law and to respond to lawful requests from competent authorities.
4.2 The Company will not use personal data for a purpose that is materially different from those listed above without first giving notice and, where required by law, obtaining consent.
4.3 The Company does not sell personal data.
Article 5. Notice Under the Thailand Personal Data Protection Act
5.1 For the purposes of Section 23 of the Personal Data Protection Act B.E. 2562 (2019) of Thailand, the Company gives the following notice:
(a) Collecting entity: APOC Co., Ltd. (株式会社APOC).
(b) Purposes of collection: as set out in Article 4 above.
(c) Categories of personal data: as set out in Article 3 above.
(d) Period of use: as set out in Article 11 below.
(e) Territory of use: Japan, Thailand, the United States of America, and — in respect of Published Content and the Media Directory, which are publicly accessible — worldwide.
(f) Recipients of use: the Company; the service providers listed in Article 9; competent authorities where required by law; and, in respect of Published Content and the Media Directory, the general public, search engines and automated crawlers.
(g) Method of use: by electronic means, including automated processing, and in printed form where used in materials described in Article 7.
(h) Rights of the data subject: as set out in Article 13 below.
(i) Consequence of not providing data: the provision of registration data is voluntary, but if it is not provided, the Company will be unable to create an account, verify a Media Partner, or provide the Service.
Article 6. Information That Is Made Public
6.1 Published Content is public. Press Releases that are published on the Service are made publicly available on the internet, are accessible to anyone worldwide, and are open to indexing, caching, reproduction, summarisation, translation and quotation by search engines, news aggregators, archiving services and automated crawlers, including crawlers operated by artificial intelligence and large language model providers. Any personal data that a Publisher chooses to include in a Press Release — such as the name, job title, email address or telephone number of a media contact — will therefore be public. Publishers should include only such personal data as they intend to be public and for which they have obtained all necessary consents.
6.2 The Media Directory is partly public. The following information about a Media Partner is published: outlet name; website URL; coverage area and subject areas; and, where provided, logo and a short description.
6.3 The following is NOT published: a Media Partner’s individual contact details (including email addresses, telephone numbers, messaging identifiers and postal addresses) and the names of individual Journalists. Such information is held by the Company and used only as described in this Privacy Policy.
6.4 The Company cannot control, and is not responsible for, the use made of public information by third parties, including any copying, caching, archiving or republication.
Article 7. Promotional and Case Study Use
7.1 As set out in Article 12 of the Terms of Service, the Company may use the following in materials describing and promoting the Service, APOC Wire and the Company’s other products and services: a User’s name, trade name, outlet name, logo and other identifiers; the names and job titles of Journalists registered by a Media Partner; Published Content and screenshots showing it; and factual information about the User’s use of the Service.
7.2 In such materials, the Company may describe a Publisher as a “Client Company” (利用企業), a Media Partner as “Participating Media” (利用メディア / 合作媒體), and a Journalist as a “Participating Journalist” (利用ジャーナリスト / 合作記者).
7.3 Such use is limited to a factual statement of registration with, use of, or participation in the Service. The Company will not state or imply that the User endorses the Company’s other products or services beyond such factual use, and will not attribute any quotation or testimonial to any User or Journalist without that person’s separate written consent.
7.4 Where a Journalist’s personal data is used under this Article, the Company relies on the consent obtained by the Media Partner under Article 12.6 of the Terms of Service. A Journalist who has not consented, or who wishes to withdraw consent, may contact the Company directly using the details in Article 16, and the Company will cease using that Journalist’s personal data in materials created after the request.
7.5 The Company is not obliged to withdraw, recall, amend or destroy materials that have already been produced, published or distributed, or copies held by third parties. This limitation reflects the practical impossibility of recalling distributed materials and does not limit any right a data subject may have under applicable law in respect of data still held by the Company.
Article 8. Direct Delivery Feature (Planned)
8.1 The Company plans to launch a feature by which a Publisher may request that a Press Release or related information be delivered directly to Media Partners selected from the Media Directory.
8.2 A Media Partner’s individual contact details will not be disclosed to Publishers. The Company will route deliveries on the Publisher’s behalf using the contact details registered with the Service.
8.3 The Company may inform the Publisher of the fact that a delivery was made and, where technically available, of delivery status such as whether a message was opened. The Company will not disclose the underlying contact details.
8.4 The Company will give Media Partners notice before this feature is launched.
8.5 A Media Partner may opt out at any time, in whole or in part, through its account settings or by contacting the Company. Opting out will not affect the Media Partner’s inclusion in the Media Directory or its access to Restricted Materials.
Article 9. Service Providers and Disclosure to Third Parties
9.1 The Company engages the following categories of service provider, which process personal data on the Company’s behalf and under contract:
(a) Hosting and content delivery: Vercel Inc. (United States);
(b) Database and authentication: Supabase (personal data is stored on servers located in Tokyo, Japan);
(c) Object storage and content delivery for images and Media Kits: Cloudflare, Inc. (United States);
(d) Email delivery, analytics and customer support tools.
9.2 The Company requires each service provider to protect personal data to a standard consistent with this Privacy Policy and applicable law, and to use it only for the purposes for which it was engaged. The list in Article 9.1 reflects the position at the effective date of this Privacy Policy and may change; the Company will update this Privacy Policy accordingly.
9.3 The Company may disclose personal data: (a) where required by applicable law, court order or a lawful request from a competent authority; (b) where necessary to protect the rights, property or safety of the Company, its Users or the public; (c) to its professional advisers under a duty of confidentiality; and (d) to a successor in connection with a merger, acquisition, reorganisation or sale of all or substantially all of its assets or of the business to which the Service relates, in which case the recipient will be bound by terms no less protective than this Privacy Policy.
9.4 Save as described in this Privacy Policy, the Company does not disclose personal data to third parties without the data subject’s consent.
Article 10. International Transfer of Personal Data
10.1 The Company is established in Japan. Personal data collected through the Service is stored primarily on servers located in Tokyo, Japan.
10.2 Personal data may also be accessed and processed in the United States of America and in other jurisdictions in which the Company’s service providers operate, and by the Company’s personnel in Japan.
10.3 Published Content and the Media Directory are publicly accessible worldwide, as described in Article 6.
10.4 By registering for and using the Service, each User consents to the transfer of personal data to, and its storage and processing in, Japan, the United States of America and such other jurisdictions as are necessary for the operation of the Service.
10.5 Data protection laws in those jurisdictions may differ from those of Thailand. The Company takes contractual and technical measures intended to ensure that transferred personal data continues to receive protection consistent with this Privacy Policy.
10.6 Cross-border transfers of personal data out of Thailand are subject to Section 28 of the Personal Data Protection Act B.E. 2562 (2019). The Company will comply with any such restriction that applies to it.
Article 11. Retention
11.1 Account and registration data: retained while the account is active and for a period of [three (3)] years after the account is closed, or for such longer period as is necessary to establish, exercise or defend legal claims or to comply with law.
11.2 Published Content: as described in Article 14.4 of the Terms of Service, Published Content may be retained and remain publicly available indefinitely as part of the public archive, including after an account is closed, in order to preserve the integrity of the archive and the validity of third-party links and citations.
11.3 Restricted Materials and access logs: retained for [twelve (12)] months from the date of access, for security and audit purposes.
11.4 Usage data and analytics: retained for [twenty-six (26)] months, after which it is deleted or aggregated so that it no longer identifies any individual.
11.5 Materials produced under Article 7: materials that have already been produced, published or distributed are not recalled or destroyed, and copies may persist indefinitely.
11.6 Where a retention period is not specified, the Company retains personal data only for as long as is necessary for the purposes set out in Article 4 or as required by law.
Article 12. Security
12.1 The Company implements technical and organisational measures intended to protect personal data against unauthorised access, alteration, disclosure, loss or destruction. These include encryption of data in transit, database-level access control (row level security), access control for Restricted Materials by means of expiring signed links, logging of access, and restriction of administrative credentials to authorised personnel.
12.2 No method of transmission or storage is completely secure, and the Company cannot guarantee absolute security.
12.3 Users are responsible for keeping their account credentials confidential and shall notify the Company immediately of any suspected unauthorised access.
12.4 In the event of a personal data breach that is likely to affect data subjects, the Company will notify affected data subjects and the competent authorities to the extent and within the timeframes required by applicable law.
Article 13. Your Rights
13.1 Under the Personal Data Protection Act B.E. 2562 (2019) of Thailand, a data subject may, in respect of their personal data held by the Company: (a) enquire about it or request to review it; (b) request a copy of it; (c) request that it be supplemented or corrected; (d) request that the Company cease collecting, processing or using it; and (e) request that it be deleted. These rights may not be waived in advance or limited by contract.
13.2 Under the Act on the Protection of Personal Information of Japan, a data subject may request disclosure, correction, addition or deletion of retained personal data, the cessation of its use, its erasure, and the cessation of its provision to third parties, in each case in the cases and on the conditions provided by that Act.
13.3 To exercise any right, please contact the Company using the details in Article 16. The Company may require reasonable evidence of identity and, where a request is made on behalf of another person, of authority. The Company will respond within the period required by applicable law and, where no period is specified, without undue delay.
13.4 Limitations. The Company may decline or limit a request to the extent permitted or required by law, including where: (a) compliance would prevent the Company from performing a statutory duty; (b) the request concerns Published Content retained as part of the public archive, in which case the Company will consider the request in good faith but is not obliged to comply except where required by law; (c) the request concerns materials already produced or distributed under Article 7; or (d) the request would infringe the rights or freedoms of a third party. Where the Company declines a request, it will explain its reasons.
13.5 The Company does not charge a fee for a reasonable request, but may charge a reasonable administrative fee where a request is manifestly unfounded, excessive or repetitive, to the extent permitted by law.
13.6 A data subject may lodge a complaint with the Personal Data Protection Committee of Thailand or the competent supervisory authority in Japan. The Company would appreciate the opportunity to address any concern first.
Article 14. Cookies and Analytics
14.1 The Service uses cookies and similar technologies for the following purposes: (a) strictly necessary — to maintain a login session, to remember language preference, and to protect against fraud and abuse; (b) analytics — to understand how the Service is used and to improve it.
14.2 Strictly necessary cookies cannot be disabled without impairing the Service. Analytics cookies may be declined where a consent mechanism is presented, and may in any event be blocked or deleted through browser settings.
14.3 Analytics data is used in aggregate. The Company does not use cookies to build advertising profiles of individuals or to serve behavioural advertising on the Service.
14.4 Third parties whose content is embedded in or linked from the Service may set their own cookies, which are governed by their own privacy policies.
Article 15. Children; Changes to this Privacy Policy
15.1 The Service is intended for organisations and for individuals aged eighteen (18) or over. The Company does not knowingly collect personal data from children. If the Company becomes aware that it has collected personal data from a child, it will delete that data.
15.2 The Company may amend this Privacy Policy from time to time. Where an amendment is material, the Company will give at least fourteen (14) days’ prior notice by posting on the Service or by email.
15.3 Where an amendment expands the purposes for which personal data already collected is used, the Company will, where required by applicable law, obtain consent before applying the amendment to that data.
15.4 Language. This Privacy Policy is made in the English language. The Traditional Chinese and Japanese texts beneath each English provision are translations provided for convenience only. In the event of any inconsistency or conflict, the English text prevails, except to the extent that applicable mandatory law provides otherwise.

1.2 当社は、本プライバシーポリシーに記載される個人情報に関する管理者です。当社は日本法に基づき設立された会社であり、民間の営利主体であって、政府機関または公的機関ではありません。
1.3 本プライバシーポリシーは、利用規約の不可分の一部を構成します。本ポリシーで定義されない用語は、利用規約に定める意味を有します。
1.4 当社は、それぞれ適用される範囲において、タイの個人情報保護法(Personal Data Protection Act B.E. 2562)および日本の個人情報の保護に関する法律を遵守します。

第3条 当社が取得する個人情報
3.1 配信事業者の登録情報: 組織名、代表者または担当者の氏名、部署および役職、メールアドレス、電話番号、ウェブサイトURL、住所、業種またはカテゴリー。
3.2 登録メディアの登録情報: 媒体名、媒体種別、ウェブサイトURL、カバー領域および取扱テーマ、発行部数または読者・視聴者情報、担当者の氏名、部署および役職、メールアドレス、電話番号、ならびに審査のために提出された資料。
3.3 ジャーナリスト情報: 登録メディアが本サービスに登録または通知したジャーナリストの氏名、役職、担当領域、および提供された場合は連絡先および写真。
3.4 コンテンツ情報: プレスリリース、画像およびキャプション、メディア限定情報、メディアキット、ならびにこれらに含まれる個人情報。
3.5 利用状況情報: IPアドレス、ブラウザの種類、デバイスおよびOS、参照元URL、閲覧ページ、アクセス日時、ならびに投稿、承認、メディアキットのダウンロード、およびダイレクト送付機能の提供開始後は送付・開封状況を含む、本サービス内での操作記録。
3.6 Cookie等の情報: 第14条に記載のとおりです。
3.7 問い合わせ情報: 当社に送信された問い合わせ、連絡およびサポート依頼の内容。
3.8 当社は、本サービスを通じて、要配慮個人情報・特種個人情報(病歴、遺伝情報、性生活、健康診断結果、犯罪の経歴等に関する情報)を意図的に取得することはありません。利用者はこれらの情報を投稿しないでください。
第4条 利用目的
4.1 当社は、以下の目的で個人情報を利用します。
(a) 本サービスの提供、運営および維持
(b) アカウントの作成および認証
(c) 登録メディアの審査・再審査、および不正または不適切な登録の防止
(d) プレスリリースの公開・配信および公開アーカイブの運営
(e) メディア一覧の運営および公開(第6条に従います)
(f) 限定素材へのアクセス制御ならびに当該アクセスの記録、監視および監査
(g) ダイレクト送付機能の提供開始後における同機能の運用(第8条参照)
(h) 変更の通知を含む、本サービスに関する利用者との連絡
(i) セキュリティの確保、濫用の防止および利用規約の履行確保
(j) 統計・分析の作成および本サービスの改善
(k) 利用規約第12条および本ポリシー第7条に定めるところにより、利用者、登録メディアおよびジャーナリストを、本サービス、APOC Wireならびに当社の他の商品・サービスの実績および事例として利用すること

4.2 当社は、事前の通知を行い、かつ法令上必要な場合には同意を取得することなく、上記の目的と実質的に異なる目的で個人情報を利用することはありません。
4.3 当社は個人情報を販売しません。
第5条 タイ個人情報保護法に基づく告知事項
5.1 タイ個人情報保護法第8条の定めに従い、当社は以下の事項を告知します。
(a) 取得主体: 株式会社APOC
(b) 取得の目的: 本ポリシー第4条に記載のとおり
(c) 個人情報の種類: 本ポリシー第3条に記載のとおり
(d) 利用期間: 本ポリシー第11条に記載のとおり
(e) 利用地域: 日本、タイ、アメリカ合衆国。公開されている公開コンテンツおよびメディア一覧については全世界。
(f) 利用の対象者: 当社、第9条に記載する外部サービス提供者、法令上必要な場合の権限ある当局。公開コンテンツおよびメディア一覧については、一般公衆、検索エンジンおよび自動クローラーを含みます。
(g) 利用の方法: 自動処理を含む電子的方法。第7条に記載する資料に用いる場合は印刷物による方法を含みます。
(h) 本人の権利: 本ポリシー第13条に記載のとおり
(i) 提供しない場合の影響: 登録情報の提供は任意ですが、提供がない場合、当社はアカウントの作成、登録メディアの審査または本サービスの提供を行うことができません。
第6条 公開される情報
6.1 公開コンテンツは公開情報です。 本サービス上で公開されたプレスリリースは、インターネット上で公に利用可能となり、全世界の誰もがアクセスでき、検索エンジン、ニュースアグリゲーター、アーカイブサービスおよび自動クローラー(人工知能・大規模言語モデル提供事業者が運用するクローラーを含みます)によるインデックス化、キャッシュ、複製、要約、翻訳および引用の対象となります。したがって、配信事業者がプレスリリースに含めることを選択した個人情報(メディア向け問い合わせ先の氏名、役職、メールアドレス、電話番号など)は公開されます。配信事業者は、公開を意図し、かつ必要な同意をすべて取得している個人情報のみを含めるようにしてください。
6.2 メディア一覧は一部が公開されます。 登録メディアについて、媒体名、ウェブサイトURL、カバー領域および取扱テーマ、ならびに提供された場合はロゴおよび簡潔な説明が掲載されます。
6.3 以下は公開されません: 登録メディアの個別の連絡先(メールアドレス、電話番号、メッセージングIDおよび住所を含みます)ならびに個々のジャーナリストの氏名。これらの情報は当社が保有し、本プライバシーポリシーに記載する方法でのみ利用します。
6.4 当社は、複製、キャッシュ、アーカイブまたは転載を含め、第三者による公開情報の利用を制御することはできず、これについて責任を負いません。
第7条 宣伝および事例としての利用
7.1 利用規約第12条に定めるとおり、当社は、本サービス、APOC Wireおよび当社の他の商品・サービスを説明し宣伝する資料において、利用者の名称、商号、媒体名、ロゴその他の識別標識、登録メディアが登録したジャーナリストの氏名および役職、公開コンテンツおよびそれを表示するスクリーンショット、ならびに利用者による本サービスの利用に関する事実情報を使用することがあります。
7.2 当該資料において、当社は、配信事業者を「利用企業」(Client Company)、登録メディアを「利用メディア」(Participating Media/合作媒體)、ジャーナリストを「利用ジャーナリスト」(Participating Journalist/合作記者)と表示することがあります。
7.3 当該利用は、本サービスへの登録、利用または参加という事実の記載に限られます。 当社は、当該事実の記載を超えて利用者が当社の他の商品・サービスを推奨している旨を述べまたは示唆することはなく、本人の個別の書面による同意なく、引用または推薦の言葉を利用者もしくはジャーナリストに帰属させることはありません。
7.4 本条によりジャーナリストの個人情報を利用する場合、当社は、利用規約第12.6条に基づき登録メディアが取得した同意に依拠します。 同意していないジャーナリスト、または同意を撤回することを希望するジャーナリストは、第16条の連絡先により直接当社にご連絡ください。当社は、当該請求後に作成する資料において、当該ジャーナリストの個人情報の利用を停止します。
7.5 当社は、既に制作、公表または頒布された資料、および第三者が保有する複製物について、撤回、回収、修正または破棄する義務を負いません。 本制限は、頒布済みの資料を回収することが事実上不可能であることを反映したものであり、当社が現に保有するデータについて本人が適用法令上有する権利を制限するものではありません。
第8条 ダイレクト送付機能(実装予定)
8.1 当社は、配信事業者が、メディア一覧から選択した登録メディアに対しプレスリリースまたは関連情報を直接送付するよう請求できる機能の提供を予定しています。
8.2 登録メディアの個別の連絡先は、配信事業者に開示されません。 当社は、本サービスに登録された連絡先を用いて、配信事業者に代わり送付の中継を行います。
8.3 当社は、送付が行われた事実、および技術的に可能な場合はメッセージが開封されたか否か等の送付ステータスを、配信事業者に通知することがあります。その基礎となる連絡先を開示することはありません。
8.4 当社は、本機能の提供開始前に登録メディアに通知します。
8.5 登録メディアは、アカウント設定または当社への連絡により、いつでも全部または一部について本機能の適用を除外(オプトアウト)できます。 オプトアウトは、メディア一覧への掲載および限定素材へのアクセスに影響しません。
第9条 外部サービス提供者および第三者への開示
9.1 当社は、以下の種別の外部サービス提供者を利用しており、これらは契約に基づき当社に代わって個人情報を取り扱います。
(a) ホスティングおよびコンテンツ配信: Vercel Inc.(米国)
(b) データベースおよび認証: Supabase(個人情報は日本・東京に所在するサーバーに保存されます)
(c) 画像およびメディアキットのオブジェクトストレージ・コンテンツ配信: Cloudflare, Inc.(米国)
(d) メール配信、アクセス解析およびカスタマーサポートツール
9.2 当社は、各サービス提供者に対し、本プライバシーポリシーおよび適用法令に整合する水準で個人情報を保護すること、および委託目的の範囲内でのみ利用することを求めています。第9.1条の一覧は本プライバシーポリシーの発効日時点のものであり、変更されることがあります。その場合、当社は本プライバシーポリシーを更新します。
9.3 当社は、(a) 適用法令、裁判所の命令または権限ある当局からの適法な要請により求められる場合、(b) 当社、利用者または公衆の権利、財産もしくは安全を保護するために必要な場合、(c) 守秘義務を負う専門家に開示する場合、(d) 合併、買収、組織再編、または資産の全部・実質的全部もしくは本サービスに係る事業の譲渡に関連して承継人に開示する場合(この場合、承継人は本プライバシーポリシーと同等以上の保護水準の条件に拘束されます)に、個人情報を開示することがあります。
9.4 本プライバシーポリシーに記載する場合を除き、当社は本人の同意なく個人情報を第三者に開示しません。
第10条 個人情報の国際移転
10.1 当社は日本に所在します。本サービスを通じて取得される個人情報は、主として日本・東京に所在するサーバーに保存されます。
10.2 個人情報は、アメリカ合衆国および当社の外部サービス提供者が事業を行うその他の法域においてアクセス・処理されることがあり、また日本の当社担当者により取り扱われます。
10.3 第6条に記載のとおり、公開コンテンツおよびメディア一覧は全世界から公にアクセス可能です。
10.4 本サービスへの登録および利用により、各利用者は、本サービスの運営に必要な範囲で、個人情報が日本、アメリカ合衆国およびその他の法域へ移転され、そこで保存・処理されることに同意します。
10.5 これらの法域における個人情報保護法制はタイのものと異なる場合があります。当社は、移転された個人情報が本プライバシーポリシーに整合する保護を引き続き受けられるよう、契約上および技術上の措置を講じます。
10.6 タイの主管機関は、タイ個人情報保護法第21条に基づき個人情報の国際移転を制限することがあります。当社は、当社に適用される当該制限に従います。
第11条 保存期間
11.1 アカウントおよび登録情報: アカウントが有効な間、およびアカウント閉鎖後[3]年間、または法的請求の確立・行使・防御のため、もしくは法令遵守のために必要なより長い期間、保存します。
11.2 公開コンテンツ: 利用規約第14.4条に記載のとおり、アーカイブの完全性ならびに第三者のリンクおよび引用の有効性を維持するため、公開コンテンツは、アカウント閉鎖後を含め、公開アーカイブの一部として無期限に保存され、公開が継続されることがあります。
11.3 限定素材およびアクセスログ: セキュリティおよび監査の目的で、アクセス日から[12]か月間保存します。
11.4 利用状況情報および分析データ: [26]か月間保存し、その後は削除するか、個人を識別できない形に集計します。
11.5 第7条に基づき制作された資料: 既に制作、公表または頒布された資料は回収も破棄もされず、その複製物が無期限に存続する可能性があります。
11.6 保存期間を特に定めていない場合、当社は、第4条に定める目的のために必要な期間、または法令が要求する期間に限り個人情報を保存します。
第12条 安全管理措置
12.1 当社は、個人情報を不正アクセス、改ざん、漏えい、滅失または毀損から保護するため、技術的および組織的措置を講じています。これには、通信経路の暗号化、データベース層でのアクセス制御(行レベルセキュリティ)、有効期限付き署名リンクによる限定素材のアクセス制御、アクセスログの記録、および管理者権限の認可された担当者への限定が含まれます。
12.2 完全に安全な送信・保存の方法は存在せず、当社は絶対的な安全性を保証することはできません。
12.3 利用者は、自己のアカウント認証情報の機密を保持する責任を負い、不正アクセスの疑いがある場合は直ちに当社に通知するものとします。
12.4 本人に影響を及ぼすおそれのある個人情報の漏えい等が発生した場合、当社は、適用法令が求める範囲および期限において、影響を受ける本人および所管当局に通知します。
第13条 本人の権利
13.1 タイ個人情報保護法に基づき、本人は、当社が保有するその個人情報について、(a) 照会または閲覧の請求、(b) 複製物の交付請求、(c) 補充または訂正の請求、(d) 取得、処理または利用の停止請求、(e) 削除の請求を行うことができます。これらの権利は、あらかじめ放棄し、または契約により制限することはできません。
13.2 日本の個人情報の保護に関する法律に基づき、本人は、同法が定める場合および条件において、保有個人データの開示、訂正、追加または削除、利用の停止、消去、および第三者提供の停止を請求することができます。
13.3 権利を行使される場合は、第16条の連絡先より当社にご連絡ください。当社は、本人確認のための合理的な資料の提出を求めることがあり、代理人による請求の場合は代理権を証する資料の提出を求めることがあります。当社は、適用法令が定める期間内に、期間の定めがない場合は不当に遅滞することなく回答します。
13.4 制限。 当社は、法令が許容しまたは要求する範囲において、請求を拒否し、または制限することがあります。これには、(a) 応じることにより当社が法令上の義務を履行できなくなる場合、(b) 請求が公開アーカイブの一部として保存される公開コンテンツに関する場合(この場合、当社は誠実に検討しますが、法令上求められる場合を除き応じる義務を負いません)、(c) 請求が第7条に基づき既に制作または頒布された資料に関する場合、(d) 応じることにより第三者の権利または自由が侵害される場合が含まれます。請求を拒否する場合、当社はその理由を説明します。
13.5 当社は、合理的な請求について手数料を徴収しません。ただし、法令が許容する範囲において、明らかに理由がなく、過度または反復的な請求については、合理的な事務手数料を申し受けることがあります。
13.6 本人は、タイまたは日本の所管監督機関に申立てを行うことができます。当社としては、まず当社にご相談いただけますと幸いです。
第14条 Cookieおよびアクセス解析
14.1 本サービスは、以下の目的でCookieおよび類似技術を使用します。(a) 必須 — ログインセッションの維持、言語設定の記憶、および不正・濫用の防止。(b) 分析 — 本サービスの利用状況の把握および改善。
14.2 必須のCookieは、無効にすると本サービスの動作に支障が生じます。分析用Cookieは、同意取得の仕組みが提示される場合には拒否することができ、またいずれの場合もブラウザの設定によりブロックまたは削除することができます。
14.3 分析データは集計された形で利用されます。当社は、Cookieを用いて個人の広告プロファイルを作成することはなく、本サービス上で行動ターゲティング広告を配信することもありません。
14.4 本サービスに埋め込まれ、または本サービスからリンクされる第三者のコンテンツは、独自のCookieを設定することがあり、これらには当該第三者のプライバシーポリシーが適用されます。
第15条 子どもについて/本ポリシーの変更
15.1 本サービスは、組織および満18歳以上の個人による利用を想定しています。当社は、子どもの個人情報を認識しながら取得することはありません。子どもの個人情報を取得したことが判明した場合、当社は当該情報を削除します。
15.2 当社は、本プライバシーポリシーを随時変更することがあります。変更が重要なものである場合、当社は、本サービス上での掲示または電子メールにより、少なくとも14日前に事前通知を行います。
15.3 変更により、既に取得した個人情報の利用目的が拡大される場合、当社は、適用法令が求めるときは、当該情報に変更を適用する前に同意を取得します。
15.4 言語。 本プライバシーポリシーは英語により作成されます。各英語条項の下に記載されるタイ語および日本語の本文は、便宜のために提供される翻訳です。不一致または矛盾がある場合、英語本文が優先します。ただし、適用される強行法規が別段の定めをする場合はこの限りではありません。
